The Service
The Service consists of dial-up Internet Protocol ("IP") Connectivity to the InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com Network, as well as access or Connectivity to any of the information sources or services which may be provided by InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com or be available from other service providers participating in or Connected to InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com Service.

Some of these additional services may be provided without charge to users of InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com, Inc Service, but separate charges may be applicable to some of these other services. The providers of such services may bill these charges to you separately. Some other providers may also have additional registration or eligibility requirements in order to use their services. By posting updated versions of this Agreement on the Service, InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com may modify the terms of this Agreement or prices for the Service, and may discontinue or revise any or all other aspects of the Service in its sole discretion and without prior notice. All such changes shall become effective upon posting of the revised Agreement on the Service, as to Service used by you after the date of such changes. The updated, on-line version of this Agreement shall supersede any prior paper or disk based copies of this Agreement that may have been in any related materials provided by InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com

Term
This Agreement for the use of the Service will be in effect from the date your completed registration is accepted by InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com This Agreement and your use of the Service may be terminated by
a. you at any time with 30 days advance written notice to InfoLinkISP.com
b. at any time with or without notice for your non-payment or other default. The provisions of InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com, Inc Acceptable Use Policy and all obligations of and restrictions on you and any user of your account with respect to the Service shall survive any termination of this Agreement.

User may cancel or terminate service at any time by giving a written, 30-day notice to the provider. However, because of our relationship with our network provider, if user cancels service in one month and then continues to be active on the service during any portion of the following calendar month, the user will be charged for the entire following month's service. Likewise, if a user establishes and uses service on the last day of a calendar month, then uses service on the first day of the next calendar month, the user will be charged for two months of service.

Example: User provides cancellation notification on the 10th of January. User continues to use the service during the first week of the following month, February. User will be billed for the entire month of February. User's service will be terminated the following month, March.

Example: User signs up for and uses service on the 31st of January, then uses service on the 1st of February; the user will be charged for two months.

All termination requests must be sent in written form to InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com at accounting@InfoLinkISP.com. If your cancellation is done through any other means, you will be liable for any fees that may have accumulated during the time the unauthorized cancellation took place and the time InfoLinkISP.com was notified.

By accepting this Agreement, you agree to pay all costs incurred in the collection of any delinquent fees due under this Agreement or the enforcement of this Agreement, including attorney fees.

If termination is made by other means other than sending 30 day written notice and the user does not pay any accumulated fees owed, your InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com account will be completely terminated and earnings will be forfeited.

Service Rates and Charges
The rates and charges for the Service shall be as set forth in your registration details or otherwise in accordance with InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com rate schedule as in effect from time to time, a copy of which is posted on-line or otherwise shall be provided to you upon request. Rates and charges, and other terms and conditions of the Service, are subject to change by InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com and will be provided on the Service. You will be billed in advance for the term of service you have chosen. And for any other services utilized by you or other users of your account which are billed for by InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com in Connection with the Service (including any applicable taxes), through your designated credit card company. When paying by credit card, the terms of the applicable credit card agreement will apply.

You understand that your account will be automatically billed on a periodic basis up to one month in advance as pre-payment for services. You authorize InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com to continue to charge the credit card you have provided, for all fees and charges due, unless you cancel your account. You understand that you must notify InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com in writing, via email, 30 days in advance of your next billing period of any request to change or discontinue this automatic charge agreement.

Other Responsibilities of User
You agree that you will be the only user of your account ID and password and that you will not transfer or disclose either your account ID or password to any other person (except that you may at your own risk and on your own responsibility permit other members of your family to access the Service using your account ID and password), and that you will be responsible for all usage of the Service and any other services accessed through the Service on your account whether or not authorized by you. You agree to pay the applicable fees as set forth in your billing statement by the due date, and to pay any interest or late fees incurred for late payment of the required fees. You agree not to transmit or publish on or over the Service any information, software or other content, which violates or infringes upon the rights of any others or to use the facilities and capabilities of the Service to conduct any business or activity or solicit the performance of any activity that is prohibited by law. You agree to comply with all applicable laws, rules and regulations in Connection with the Service. You acknowledge that you are aware that certain content on the internet may be unsuitable for minors (persons under 18 years of age). You agree to supervise usage of the Service by any minors whom you permit to use the Service. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com may modify this Agreement from time to time. It is your responsibility to check this Agreement regularly to determine whether this Agreement has been modified. If you do not agree to any modification of this Agreement, you must immediately stop using the Service.

Limitations of Warranties and Liability; Disclaimer of Warranties
YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. NEITHER INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM NOR ANY OF ITS UNDERLYING SERVICE PROVIDERS, INFORMATION PROVIDERS, LICENSORS, EMPLOYEES, OR AGENTS WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM OR ANY OF ITS UNDERLYING SERVICE PROVIDERS, INFORMATION PROVIDERS, LICENSORS, EMPLOYEES, OR AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE. THE SERVICE IS DISTRIBUTED ON AN "AS IS", "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE, OTHER THAN THOSE WARRANTIES (IF ANY) WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION, OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS SERVICE AGREEMENT, ALL SUCH WARRANTIES BEING EXPRESSLY DISCLAIMED. NEITHER INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM NOR ANY OF ITS UNDERLYING SERVICE PROVIDERS, INFORMATION PROVIDERS, LICENSORS, EMPLOYEES,OR AGENTS SHALL HAVE ANY LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SPECIAL DAMAGES SUFFERED BY YOU OR ANY OTHER PARTY AS A RESULT OF THE OPERATION OR MALFUNCTION OF THE SERVICE, REGARDLESS OF WHETHER OR NOT SUCH PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU EXPRESSLY ACKNOWLEDGE THAT THE PROVISIONS OF THIS SECTION SHALL ALSO APPLY TO ALL CONTENT OR OTHER SERVICES AVAILABLE THROUGH THE SERVICE. YOU AGREE THAT YOU WILL NOT IN ANY WAY HOLD INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM RESPONSIBLE FOR ANY SELECTION OR RETENTION OF, OR THE ACTS OR OMISSIONS OF, THIRD PARTIES CONNECTION WITH THE SERVICE (INCLUDING THOSE WITH WHOM INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM MAY CONTRACT TO OPERATE VARIOUS AREAS ON THE SERVICE).

Remedies of User
Your sole and exclusive remedy for any failure or non-performance of the Service (including any associated software or other materials supplied in Connection with the Service) shall be for InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com to use reasonable efforts to effectuate an adjustment or repair of the Service and, in the event such downtime exceeds twenty-four consecutive hours, to receive a pro-rata refund or credit of or against any charges otherwise payable for the Service for the period of Service downtime.

Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM , ITS AFFILIATES, ITS LICENSERS, ITS CONTRACTORS OR THEIR RESPECTIVE EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT RESULT IN ANY WAY FROM USER'S USE OF OR INABILITY TO USE THE SERVICE OR TO ACCESS THE INTERNET OR ANY PART THEREOF, OR USER'S RELIANCE ON OR USE OF INFORMATION, SERVICES OR MERCHANDISE PROVIDED ON OR THROUGH THE SERVICE, OR THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION OR TRANSMISSION, ANY FAILURE OF PERFORMANCE, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO ALTERATION OF OR USE OF USER'S ACCOUNT, WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE OR UNDER ANY OTHER CAUSE OF ACTION. IN THE EVENT INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM IS FOUND LIABLE UNDER ANY CIRCUMSTANCE UNDER THE TERMS OF THIS AGREEMENT, INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM S LIABILITY SHALL BE LIMITED TO THE UNUSED BALANCE OF USER'S SUBSCRIPTION PAYMENT PRO-RATED TO REFLECT THE CURRENT TERM.

UNDER NO CIRCUMSTANCES SHALL INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM , ITS AFFILIATES, ITS LICENSERS, ITS CONTRACTORS OR THEIR RESPECTIVE EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES EXPERIENCED BY USER THAT RESULT FROM VIRUSES, CANCELBOTS, WORMS, TROJAN HORSES OR OTHER HARMFUL OCCURANCES.

If User is dissatisfied with the Service or with any terms, conditions, rules, policies, guidelines or practices of InfolinkISP.com, Infolinknetwork.com, TalkByPC.com, InfoLinkTel.com AND Netphone2phone.com in operating the Service, User's sole and exclusive remedy is to cancel per the terms outlined elsewhere in this Agreement.

Indemnification by User
You shall indemnify and hold InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com and any of its underlying service providers, information providers, licensors, employees or agents from and against any and all claims, demands, actions, causes of action, suits, proceedings, losses, damages, costs, and expenses, including reasonable attorneys fees, arising from or relating to your use of the Service, or any act, error, or omission of you or any user of your account in Connection therewith, including, but not limited to, matters relating to incorrect, incomplete, or misleading information; libel; invasion of privacy; infringement of a copyright, trade name, trademark, service mark, or other intellectual property; any defective product or any injury or damage to person or property caused by any products sold or otherwise distributed through or in Connection with the Service; or violation of any applicable law.

Age Limit
User represents to InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and that he or she is 18 years of age or older. User understands that certain materials available while using the Service provided under the terms of this Agreement may not be suitable for individuals under the age of 18.

Sexually Explicit Materials
User understands that the Internet contains unedited materials some of which are sexually explicit or may be offensive. User accesses such materials at his or her own risk. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com has no control over and accepts no responsibility whatsoever for such materials.

Prohibited Uses
User may not: restrict or inhibit any other user from using and enjoying the Internet; post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, pornographic, profane, or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law, including without limitation the U.S. export control laws and regulations; post on webspace provided any sexually explicit materials or materials that may be offensive. Post or transmit any information or software which contains a virus, cancelbot, trojan horse, worm or other harmful component; post, publish, transmit, reproduce, distribute or in any way exploit any information, software or other material obtained through the Service for commercial purposes (other than as expressly permitted by the provider of such information, software or other material); upload, post, blish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the Service which is protected by copyright, or other proprietary right, or derivative works with respect thereto, without obtaining permission of the copyright owner or rightholder; upload, post, publish, transmit, reproduce, transmit or distribute in any way any component of the Service itself or derivative works with respect thereto; send unsolicited advertising or promotional materials to other network users (See section titled "Messaging"); allow users to run Maillist, Listserv or any form of auto-responds from User's account; run or activate processes while User is not logged in; violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material including that deemed threatening or obscene, or engage in any kind or illegal activity; attempt to defeat any idle timer or system tool intended to enforce the part-time and personal nature of User's connection, including the use of pingbots and other methods of avoiding timing disconnection (See section titled "Limitations of Dial-Up Services"); or violate any of the rules, regulations and policies of those networks and computer systems accessed via User's account.

InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com has no obligation to monitor the Service. However, User agrees that InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com has the right to monitor the Service electronically from time to time and to disclose any information as may be necessary to satisfy any law, regulation or other governmental request, to operate the Service properly, or to protect itself or its subscribers. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com will not intentionally monitor or disclose any private E-mail message unless required by law. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole and absolute discretion, are unacceptable, undesirable, or in violation of this Agreement. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com reserves the right to suspend access to the Service for User's account. The account's suspension may be rescinded within the sole and absolute discretion of InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com following payment of a reconnection charge, to be determined by InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com in its sole and absolute discretion.

Messaging
User agrees to limit their use of the InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com service, specifically regarding the use of InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com 's electronic (email) services, to the following restrictions:
a. Unauthorized Use of Relay Servers:
User agrees that any unauthorized use of any email server located throughout the Internet for the purposes of relaying or distributing messages is prohibited.
b. Fraudulent Addressing:
User agrees that the purposeful distribution of any email message where the return address, originator's address, or any other identifiable aspect of the message has been purposefully altered, Is prohibited. User may not purposefully misrepresent the origination information of any email messages sent while using the InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com service.
c. Fraudulent Content:
User agrees to be held responsible for the distribution of fraudulent materials.
d. Spam
User agrees not to use the practice of sending out "unsolicited" email known as "Spam" on our servers or network. The user will be held responsible for such actions that were performed through their accounts. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com defines "spam" as sending email to more than 25 recipients at a time or sending more than 100 emails at a time.
e. Other Email Restrictions:
User may not send from an email address that is not their own. User may not send an email that is over 10 Mb in size. Provider may block certain attachment types used in transmitting viruses. Email is kept on our server for only 60 days.

VIOLATION OF ANY OF THESE TERMS WILL RESULT IN IMMEDIATE TERMINATION OF SERVICES. FURTHERMORE, VIOLATION OF ANY OF THESE TERMS, RELATING TO THE TERMS DESCRIBED WITHIN THIS "MESSAGING" SECTION OF THIS DOCUMENT, WILL RESULT IN THE IMMEDIATE PENALTY OF $200. INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM RESERVES THE RIGHT TO CHARGE USER'S CREDIT CARD, IF ON FILE FOR USE IN PAYMENT OF INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM SERVICES, A ONE-TIME FEE OF $200 PER VIOLATION OF THESE TERMS. IN THE EVENT USER PRE-PAYS FOR THEIR INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM SERVICE VIA CASH, CHECK, OR MEANS OTHER THAN CREDIT CARD, INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM RESERVES THE RIGHT TO INVOICE AND HOLD USER RESPONSIBLE FOR THE ONE-TIME FEE OF $200 PER VIOLATION OF THESE TERMS. USER ALSO AGREES TO THE IMMEDIATE TERMINATION OF INFOLINKISP.COM, INFOLINKNETWORK.COM, TALKBYPC.COM, INFOLINKTEL.COM AND NETPHONE2PHONE.COM SERVICES FOR VIOLATION OF ANY OF THESE TERMS.

Use of Materials, Marks and Information
a. You may use, copy and distribute the materials found on the Service for internal, noncommercial, informational services only. All copies that you make of the material must bear any copyright, trademark or other proprietary notice, which pertain to the material being copied. Except as authorized in this paragraph, you are not being granted a license under any copyright, trademark, patent or other intellectual property right in the material or the products, services, processes or technology described therein. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com, its affiliates and/or any third party owner of such rights retain all such rights.
b. The InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com and logos and all related product and service names, design marks and slogans are the property of InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com or its affiliates. You are not authorized to use any InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com name or mark in any advertising, publicity or in any other commercial manner without the prior written consent of InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com Inc.
c. Any feedback, data, answers, questions, comments, suggestions, ideas or the like, which you send to InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com will be treated as being non confidential and nonproprietary. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com assumes no obligation to protect such information from disclosure and will be free to reproduce, use, and distribute the information to others without restriction. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com will also be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and services incorporating such information. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com may also use your status as a subscriber to the Service for the purpose of marketing to you other InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com products and services.

Endorsements
All product and service marks contained on or associated with the Service that are not InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com marks are the trademarks of their respective owners. Browser Software
If any Internet browser or other software has been provided to you for use with the Service, you agree to be bound by and to comply with the terms and conditions of the separate software license, which is applicable to and was provided to you along with such software.

Additional Phone Charges
You agree that you are solely responsible for determining whether the access number you use is subject to any additional charges. It is your responsibility to contact your telephone company to determine whether the access number you select is subject to additional charges. You agree to pay any charges you incur by using a long distance number to Connect to InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com including those that may be billed to you by a third party. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com will not reimburse you for any charges incurred by you as a result of selecting an access number that is subject to additional and/or long distance charges.

General
a. InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com shall not be responsible for any delay in delivery or performance of any of its duties here under due to acts of God, acts or omissions of any regulated telephone network or any other occurrence commonly known as force majeure.
b. Your right to use the Service is not transferable and is subject to any limits established by InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com and by your credit card company.
c. No action, regardless of form, arising out of the Service or this Agreement may be brought by you or any party claiming by, through or under you more than one year after the cause of action has arisen.
d. This Agreement and the Service shall be governed by the laws of the State of California, without regard to its conflicts of laws provisions. If any provision or provisions hereof shall be held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be in any way affected or impaired thereby.
e. This Agreement and any modifications published by InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com over the Service constitute the entire and only agreement between you and InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com with respect to the Service and supersede all other communications and agreements with regard to the subject matter hereof.
f. You are responsible for and must provide all telephone and other equipment, software (other than any browser software that may be provided by InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com) and services necessary to access the Service, including any inter exchange (interLATA) long distance service which must be provided by the carrier or other provider of your choice.
h. You assume all risk and liability of your use of the Internet or other services or content accessible through InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com Service, including your continuous compliance with this Agreement.

How We May Use Information You Provide Us
Do not send us any confidential or proprietary information. Any feedback, data, answers, questions, comments, suggestions, ideas or the like, which you send to us will be treated as being non confidential and nonproprietary. We assume no obligation to protect such information from disclosure and will be free to reproduce, use, and distribute the information to others without restriction. We will be also be free to use any ideas, concepts, know-how or techniques contained in information that you send us for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products and services incorporating such information.

Advertising by spamming, is a violation of InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com Agreement and Anti-Spam Policy. This includes any URLs off InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com sites, whether or not the spam was transmitted from any of the InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com sites or networks. It is InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com's position that any Web site engaged or benefiting from spam shall be removed from our network. However, if you feel other measures can be taken which will stop the spam, you may contact InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com Internet Abuse Investigations team at abuse@InfoLinkISP.com to discuss the incident. It is imperative that you respond to this complaint so that the Internet Abuse Investigations team will know the issue is resolved.

Restricted Content
You agree not to post or transmit any of the following restricted contents: Illegal, Abusive or Unethical Activities include, but are not limited to, pornography, obscenity, nudity, violations of privacy, hacking, computer virus, gambling, or promotion of gambling, and any harassing or harmful materials or uses, as determined by us. You agree to indemnify and hold us harmless from any claim resulting from your publications or use of Illegal, Abusive or Unethical materials.

Limitation of Dial-Up Services
The sole purpose of these limitations are intended to limit the amount of unnecessary use of InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com Services by any such User, which restricts overall InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com system availability for other such Users. These limitations apply only to Dial-Up access Services offered by InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com.

Idle Timeout
User agrees to have their online session automatically terminated after ten (10) minutes of consecutive inactivity. Inactivity is defined as less than 500 bytes of data transferred between User's modem and the InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com Service.

Maximum Single Session
User agrees to have an online session automatically terminated after five (5) hours of consecutive time, regardless of data transferred during such specific online session.

Minimum Re-Connect Limit
User understands they cannot log back onto the InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com system for a period of one (1) minute following the termination of their previous online session, regardless of the reason for the previous session's termination.

Multiple, Concurrent Online Sessions
User agrees to maintain no more than one (1) concurrent online session for each Dial-Up account purchased.

30-Hour Limitation
User agrees to not use the Service as a dedicated connection. The determination of what a dedicated connection is shall be at the sole determination of InfoLinkISP.com, InfoLinkNetwork.com, TalkByPC.com, InfoLinkTel.com and Netphone2phone.com. User agrees that they will be limited to 30-hours of access per calendar month. If a User exceeds the 30-hour they will be charged at the rate 0f 1.9¢ per minute for any overage in the 30 day billing period.
